Employment and Workers Compensation

, , osaagEmployment and Workers Compensation is the area of law that deals with what happens if you are injured at work or are wrongfully terminated.

Workers Compensation

Illinois Law requires most employers to carry workers compensation insurance.  This insurance is designed to cover issues which arise when employees are injured on the job in the scope of employment.  Unfortunately, Employers will sometimes attempt to deny a workers right to access this benefit.  Legal action taken is designed to ensure workers get what they are entitled to.

Employment Discrimination

Employers are not allowed to discriminate against their employees. To “discriminate” against someone means to treat that person differently, or less favorably, for some reason. Often times this comes in the form of discrimination on the  basis of Sex, Race, Nationality, Sexual Orientation, or other ability.  It manifests itself in the form of harassment, improper questioning, denial of necessary workplace modifications, and retaliation for defending ones rights.  In Illinois, a person who has been discriminated against can take action with the Illinois Department of Human Rights and the Federal Equal Opportunity Employment Commission at the same time.  Our representation will take into account all possible outcomes through both agencies.

Wrongful Termination

Wrongful termination can come in several forms.  Creation of a hostile work environment which forces an individual to quit is known as silent termination. Termination as a result of complaining about discrimination or harassment is retaliatory discharge.  Termination for failure to accommodate a special physical or health related need is discriminatory termination.  All of these have remedies under Illinois and Federal Law.
